Rep. Lamar Smith’s “Keep Our Community Safe Act of 2011” Creates More Problems than Solutions [1]

One of the ugliest myths in the immigration debate involves the relationship between immigrants and crime. While studies repeatedly have shown that immigrants are less likely to commit crimes than native-born Americans, many politicians exploit the public’s fear of crime to advance a restrictive immigration agenda. One of the latest attempts to do so is the “Keep Our Communities Safe Act of 2011,” or H.R. 1932, introduced by Rep. Lamar Smith (R-TX). This bill seeks to expand the authority of the Department of Homeland Security (DHS) to subject certain immigrants to indefinite—that is, potentially life-long—detention, even though the Supreme Court has held that such detention raises serious constitutional concerns.

This proposal relies on continued detention of immigrants—many of whom have never committed a crime—as a stand-in for fixing the underlying problems of our broken immigration system. The evidence suggests that this bill would increase costs, put further strain on the judicial system, and do little to keep America safe. Read more... [1]

Understanding Prosecutorial Discretion in Immigration Law [3]

Updated 06/29/11 - Frustrated by the lack of comprehensive immigration reform, many advocates, from grassroots community organizers to Members of Congress, have begun calling on President Obama to take action. They want the President and his Administration to use the power of the executive branch to prevent or defer removals, to revisit current policies and priorities, and to interpret the law as compassionately as possible. The specific requests vary greatly. Senators Richard Durbin (D-IL) and Richard Lugar (R-IN), for instance, last year asked the Department of Homeland Security (DHS) to defer the removal of young people who qualified for legal permanent residence until such time as their legislation, the DREAM Act, became law. In April 2011, nineteen Democratic and Independent U.S. Senators, including Senators Harry Reid (D-NV), Richard Durbin (D-IL), and Kristin Gillibrand (D-NY), reiterated the call to stop the removal of all students who meet the strict requirements of the DREAM Act. While the DREAM Act is frequently invoked, many community groups have also called for exercising prosecutorial discretion in individual cases by declining to put people in removal proceedings, terminating proceedings, or stopping removals in cases where people have longstanding ties to the community, U.S.-citizen family members, or other characteristics that merit a favorable exercise of discretion. In June 2011, Immigration and Customs Enforcement (ICE) Director John Morton issued a memorandum directing ICE staff to consider many of these same factors when deciding whether or not to exercise prosecutorial discretion. Integration is an often overlooked but key component of U.S. immigration policy. Successful integration of immigrants fuels their success, strengthens communities, and builds bridges between newcomers and other community members. Time and again, the influx of immigrants into a community has been shown to reverse economic decline and breathe new life into urban areas, small towns, and rural communities. Moreover, integration can be a key to entrepreneurship and future economic growth. For example, research by Richard Florida and Charlotta Mellander found that nations which focus more on immigrant integration have higher levels of economic competitiveness [6], are more innovative [7], and have higher rates of entrepreneurship [8]. More than two years into the Obama Administration, it is still unclear whether President Obama’s immigration agenda will ultimately be remembered as an enforcement-driven enterprise, or one that uses the full force of executive branch authority to improve our badly broken system. Administration officials claim that, in the absence of Congressional action, their hands are tied and they must simply enforce the dysfunctional laws that are now on the books. President Obama can and should infuse the implementation of immigration law with the same values and priorities that define his legislative agenda.

Unauthorized Immigrants Pay Taxes, Too [16]

Estimates of the State and Local Taxes Paid by Unauthorized Immigrant Households

Tax Day is an appropriate time to underscore the often-overlooked fact that unauthorized immigrants pay taxes. The unauthorized, like everyone else in the United States, pay sales taxes. They also pay property taxes—even if they rent. At least half [17] of unauthorized immigrants pay income taxes. Add this all up and it amounts to billions in revenue to state and local governments. The Institute for Taxation and Economic Policy [18] (ITEP) has estimated the state and local taxes paid in 2010 by households that are headed by unauthorized immigrants. These households may include members who are U.S. citizens or legal immigrants. Collectively, these households paid $11.2 billion in state and local taxes. That included $1.2 billion in personal income taxes, $1.6 billion in property taxes, and $8.4 billion in sales taxes. The states receiving the most tax revenue from households headed by unauthorized immigrants were California ($2.7 billion), Texas ($1.6 billion), Florida ($806.8 million), New York ($662.4 million), and Illinois ($499.2 million) {See Figure 1 and Table 1}. These figures should be kept in mind as politicians and commentators continue with the seemingly endless debate over what to do with unauthorized immigrants already living in the United States. In spite of the fact that they lack legal status, these immigrants—and their family members—are adding value [19] to the U.S. economy; not only as taxpayers, but as workers, consumers, and entrepreneurs as well. E-Verify and the Social Security Administration: A Rocky Road Ahead for U.S. Seniors [21]

Many who support deportation-only immigration measures want to expand the E-Verify electronic employment verification system. However, doing so would place enormous additional responsibilities on the Social Security Administration (SSA)—an already overburdened agency. If SSA has to spend time and resources verifying Social Security numbers and fixing database errors for work authorization purposes, SSA will have less time and resources to handle its primary function: providing benefits to millions of deserving Americans. That’s why the AARP, the National Committee to Preserve Social Security and Medicare, and other organizations have voiced their concerns over mandatory E-Verify. In 2007, the president of the National Council of Social Security Management Associations, Inc. testified that mandatory E-Verify could “cripple SSA’s service capabilities” and negate any progress in addressing the backlog of applications for disability benefits. The Diversity Visa System: A Fact Sheet [23]

What is the diversity visa lottery?

The diversity visa lottery was created to encourage legal immigration to the U.S. from countries other than the major immigrant sending countries. The current immigration system favors individuals who have close relationships with family members or employers in the U.S. People who do not have close family or employment in the U.S. have very few opportunities for permanent, legal immigration to the U.S.

The diversity immigrant category was created by the Immigration Act of 1990 (P.L. 101-649) to stimulate “new seed” immigration from parts of the world that are under-represented in the U.S. The Nicaraguan Adjustment and Central American Relief Act of 1997 (NACARA) temporarily reduced the 55,000 annual ceiling by up to 5,000 annually to offset immigrant visa numbers for certain NACARA beneficiaries. As of now, the diversity visa ceiling is still set at 50,000, and it is unclear how many more years the offset will continue.

The diversity lottery makes visas available each year to natives of countries with fewer than 50,000 total immigrant admissions over the preceding five years. Natives of Mexico, India, China, and other countries that send large numbers of immigrants to the U.S. are not eligible.

The U.S. Economy Still Needs Highly Skilled Foreign Workers [25]

And Arbitrary Caps on H-1B Visas Still Don’t Meet that Need

It might seem that persistently high unemployment rates over the past few years have rendered moot the debate over whether or not the United States really “needs” the highly skilled foreign workers who come here on H-1B temporary visas. But the demand for H-1B workers still far outstrips the current cap of only 65,000 new H-1B visas that can be issued each year. In fact, from fiscal year 1997 to 2011, employers exhausted this quota before the fiscal year was over (except from 2001 to 2003, when the ceiling was temporarily increased). As a number of studies make clear, the presence in a company of highly skilled foreign workers whose abilities and talents complement those of native-born workers actually creates new employment opportunities for American workers. Yet the arbitrary numerical limits placed on H-1Bs are incapable of responding to the changing demand for H-1B workers. This is unfortunate, given that the international competitiveness of the U.S. economy will continue to depend heavily on the contributions of H-1B professionals and other high-skilled workers from abroad for many decades to come.
