National Wave of Complaints Highlights Rampant Abuse by U.S. Customs and Border Protection and Dire Need for Reform

Washington, D.C. – Over the past week, an alliance of immigration groups, private attorneys and a law school clinic joined forces in filing complaints targeting abuses by U.S. Customs and Border Protection (CBP) across the country. Ten damages cases have been filed alleging unlawful CBP conduct in northern and southern border states. These cases are the latest illustrations of an ongoing pattern of rampant misconduct against both immigrants and U.S. citizens in these states.   

This effort, which was coordinated by the American Immigration Council, the National Immigration Project of the National Lawyers Guild, the Northwest Immigrant Rights Project, and the ACLU of San Diego and Imperial Counties, highlights CBP agents’ unlawful use of their enforcement authority. Border Patrol agents routinely exceed their statutory mandate by conducting enforcement activities outside border regions, making racially motivated arrests, employing derogatory and coercive interrogation tactics, and imprisoning arrestees under inhumane conditions. The cases include claims for unlawful search and seizure, false imprisonment, intentional infliction of emotional distress, assault, and battery.

Groups Mobilize NY Immigrant Vote

This year, with tight congressional races for state Assembly and Senate elections, their goals are to demonstrate the impact of that voting bloc, which already counts more than 1 million registered voters in New York, according to a new study by the Immigration Policy Center.

Court Holds Traditional Standard Applies to Stays of Removal Pending Petitions for Review

The Supreme Court held that a court of appeals should apply the traditional criteria governing stays when adjudicating a stay of removal pending a petition for review. In doing so, the Court rejected the government’s argument that the stringent standard in INA § 242(f)(2) (“clear and convincing evidence” that the removal order “is prohibited as a matter of law") applies. The Court’s decision reversed the Fourth and Eleventh Circuits, which had held that INA § 242(f)(2) applies to stays of removal pending petitions for review. Read more...

Federal immigration agencies must improve reform efforts beyond deportation, report finds

As Florida business and faith leaders speak out against state immigration-enforcement proposals, a new report released Tuesday raises questions about President Obama’s leadership in crafting a federal solution.

Florida business and faith leaders who spoke as part of a National Immigration Forum press conference on Wednesday said proposed state legislature immigration bills are harmful and that immigration is a federal problem that requires a federal solution.

Adam Babington, vice president of government affairs for the Florida Chamber of Commerce said the state needs a federal, consistent immigration policy.

But an Immigration Policy Center report released on Tuesday concludes the Obama Administration and the Department of Homeland Security are not using their extensive authority to make the necessary changes to immigration policy.

Homeland Security is responsible for the nation’s three immigration agencies: U.S. Citizenship and Immigration Services, Customs and Border Patrol and Immigration and Customs Enforcement (aka ICE).

The Immigration Policy Center report states:

From the beginning of the Obama Administration, there has been a tension between enhanced immigration enforcement and a push for comprehensive immigration reform (CIR). This tension increased significantly in 2010 as the Administration ramped up its immigration-enforcement efforts at the expense, many believe, of the very people most likely to benefit from legalization and CIR.

The report adds, “the public looked to the President and his Department of Homeland Security (DHS) for some measure of immigration relief. For the most part, they didn’t find it.”Read more...
